1. SCOPE OF THE GTC AND PURPOSE
These General Terms and Conditions of Sale (or "GTC") apply, without restriction or reservation, to all sales concluded by SARL JULIE SION, a limited liability company with a share capital of €15,000, registered with the Paris Trade and Companies Register under number 511 924 110, whose registered office is located at 27 rue de Paris, 93000 Bobigny, France, represented by its legal representative, duly authorized for the purposes hereof, ("the Seller") to non-professional buyers ("Customers" or "Customer" or "Buyer" or "Buyers"), who wish to purchase the products offered for sale by the Seller ("Products") on the website "www.juliesion.com" ("the Website").
The Site is an e-commerce platform that allows Internet users to purchase products as defined below. The Terms and Conditions specify, in particular, the conditions for ordering or subscribing, payment, delivery, and the management of any returns of Products ordered by Customers. The Site and the Products are intended exclusively for individuals and are not intended for professionals and are therefore subject to Articles L. 111-1 et seq. of the French Consumer Code.
The Terms and Conditions exclusively govern the sale of the Products as offered on the Site.
Acceptance of the Terms and Conditions is confirmed upon finalization of the Order validation by the "double-click" process as described in Article 4.2 of the Terms and Conditions. This acceptance can only be full and complete. Any qualified acceptance is considered null and void.
These Terms and Conditions apply to the exclusion of all other conditions, including those applicable to sales in stores or through other distribution and marketing channels. These Terms and Conditions are accessible at any time on the Website and will prevail, where applicable, over any other version or any other contradictory document. The Customer declares to have read and accepted these Terms and Conditions by checking the box provided for this purpose before implementing the Order process, as well as the general conditions of use of the Website. The version applicable to the Customer's purchase is the one in effect on the Website on the date the Order is placed or the Subscription is purchased. The Seller reserves the right to modify the terms, conditions and notices of these General Conditions at any time. The Seller will notify the Customer of any new General Conditions which will be deemed accepted by the Customer.
Unless proven otherwise, the data recorded in the Seller's computer system constitutes proof of all transactions concluded with the Customer. These General Terms and Conditions are in effect and binding on users of the Site from the moment they are posted online. Validation of the Order or subscription to the Subscription by the Customer constitutes acceptance of these General Terms and Conditions without restriction or reservation. The Customer acknowledges that they have the required capacity to contract and acquire the Products offered on the Site or to subscribe to a Subscription as offered on the Site. The General Terms and Conditions are those in effect on the date the Order is placed.
These General Terms and Conditions are permanently accessible at the following address: www.juliesion.com.com, in French only, in a digital format allowing them to be printed and/or downloaded (in accordance with Article 1125 of the French Civil Code), so that the Customer may reproduce or save them.
These General Terms and Conditions and the Order Summary sent to the Customer form a contractual whole summarizing all the agreements entered into between the parties.
It is specified that purchases of Products on the Site are reserved for non-commercial individuals who are consumers and have full legal capacity. The Site does not permit the purchase of Products for resale.
By simply confirming their Order on the Site, the Buyer declares that they have read, understood, and accepted without reservation the terms of said Order or Subscription, as well as these General Terms and Conditions in their entirety.
2. DEFINITIONS
"Buyer or Customer": An adult consumer individual purchasing one or more Products for their personal needs or subscribing to a subscription through the Site;
"Order": The Buyer's purchase order for one or more Products through the Site;
"JULIE SION": Limited liability company with a share capital of €15,000, registered with the Paris Trade and Companies Register under number 511 924 110, whose registered office is located at 27 rue de Paris – 93000 BOBIGNY, offering the Products for sale through the Website it operates;
"Party(ies)": Buyer and/or Seller;
"Product(s)": Good(s) offered for sale on the Website;
"Site": Merchant site accessible from the French version of the website on which JULIE SION, the Seller, offers the Products for sale;
"User": Any person using the Website or any of the services offered on it.
